Electronic Agreement & Payment

• By electronically accepting the estimate or signing a paper copy, the customer acknowledges and agrees to all terms and payment requirements outlined in the estimate.
• Prices are subject to change only with the customer’s approval.
• Richards’ LLC requires a 50% deposit of the total project cost before materials are ordered and the project is scheduled.
• The remaining 50% balance is due in full upon completion of the project. Any unpaid balance may be subject to additional fees.
• Estimates are valid for 30 days from the date issued.
• Richards’ LLC reserves the right to photograph completed work and use before-and-after project images on its website and/or social media for marketing purposes. Customers who do not wish to have their project photographed or featured must notify Richards’ LLC before work begins.

Pre-Project Requirements

• Richards’ LLC reserves the right to cancel or postpone work due to unforeseen circumstances. When applicable, deposits will be refunded where possible.
• Projects will be scheduled as soon as reasonably practical after Richards’ LLC receives the customer’s electronically signed agreement and the required 50% deposit. Scheduling is dependent upon current workload, material availability, labor availability, weather, and other circumstances beyond our control.
• The customer is responsible for ensuring that the work area is clean, clear, and free of obstructions before the scheduled start date. Additional charges may apply if Richards’ LLC is required to clear, clean, or prepare the work area beyond the scope of the agreed-upon project.
• The customer must provide unobstructed access to the work area, adequate lighting, appropriate electrical power, and working water as reasonably required for the project.
• The customer is responsible for identifying and properly isolating any gas, electrical, plumbing, or other fixtures that may interfere with the work before the project begins and for having them reinstated after completion.

During the Project & Application

• Unless specifically stated in the estimate or agreement, the project price does not include the reinstatement, caulking, or repair of joints or cracks beyond the repairs required for proper application of the epoxy coating system.
• No allowance is made for dewatering or for conditions caused by inclement weather or other environmental factors. Cleaning, clearing, moisture conditions, weather, or other site conditions may delay the project and/or result in additional charges.
• Richards’ LLC is not responsible for delays caused by product or material suppliers. Materials will be ordered after the agreement has been electronically accepted and the required 50% deposit has been received.
• Richards’ LLC uses dustless grinding techniques to minimize airborne dust and debris; however, dust, pollen, debris, or other airborne particles may settle into the coating while it is being applied or cured. Richards’ LLC is not responsible for imperfections caused by airborne contaminants. Customers are responsible for keeping people, pets, and unnecessary items away from the work area and for providing appropriate protection for surrounding areas during the application and curing process.
• Richards’ LLC is not responsible for damage to the prepared surface or completed coating caused by customer negligence, misuse, unauthorized access, or premature use. Any costs associated with repairing such damage will be the customer’s responsibility.
• Richards’ LLC is not responsible for marks or surface impressions resulting from the necessary use of high-speed grinding or other equipment required to properly prepare the concrete substrate.

Post-Project & Curing

• Richards’ LLC takes reasonable precautions to minimize irregularities and imperfections. However, epoxy flooring systems are installed and finished by hand, and minor variations may naturally occur. By accepting the project, the customer acknowledges and accepts that minor irregularities or imperfections may be present. These may include, but are not limited to, roller marks, reflective cracking, minor pinholes, color variation, or other minor surface inconsistencies.
• Epoxy flooring systems require adequate curing time before the surface can be used. Foot traffic should be avoided for a minimum of 24–48 hours after completion, while longer curing periods are required before allowing vehicles, furniture, equipment, storage systems, appliances, or other heavy loads onto the surface. Specific curing times may vary depending on the system installed and environmental conditions.
• Richards’ LLC is not responsible for defects, damage, or premature wear resulting from early or improper use of the flooring system.
• Some epoxy systems may require up to 7 days to achieve full chemical cure. During this curing period, the customer must not expose the floor to water, cleaning agents, chemicals, or other substances that could negatively affect the appearance, performance, or curing of the system.
• Certain epoxy systems may yellow or chalk when exposed to ultraviolet (UV) radiation or direct sunlight. Interior areas that receive direct sunlight may experience discoloration if the customer selects a system without a UV-resistant sealer. Richards’ LLC is not responsible for UV-related discoloration when a non-UV-resistant system has been selected.

Warranty

Richards’ LLC will use reasonable care and accepted industry practices when preparing the substrate and installing the flooring system. Installation will be performed in accordance with applicable manufacturer and supplier technical recommendations.

Richards’ LLC warrants the flooring system against defects caused by improper substrate preparation or installation workmanship for a period of one (1) year from the effective date of installation, subject to the exclusions outlined below.

This warranty is limited to defects directly attributable to Richards’ LLC’s preparation or installation workmanship. The warranty does not cover failures, defects, damage, or deterioration resulting from:

• Concrete fracture or failure within the substrate;
• Structural movement, including stress fractures;
• Cracks, ruptures, or movement within the structural base;
• Mechanical damage, impact, abrasion, misuse, or neglect;
• Faulty structural design or pre-existing structural defects;
• Rising moisture, hydrostatic pressure, or moisture-related conditions;
• Oil, chemicals, or other contaminants within or on the substrate;
• Accidents, extreme thermal conditions, natural disasters, acts of God, criminal activity, or other circumstances beyond Richards’ LLC’s reasonable control.

The warranty does not cover normal wear and tear, cosmetic variations inherent to a hand-installed flooring system, or damage resulting from failure to follow Richards’ LLC’s post-installation care and curing instructions.

Any warranty claim must be reported to Richards’ LLC promptly after the customer becomes aware of the alleged defect. Richards’ LLC reserves the right to inspect the flooring system and determine whether the condition is covered under this warranty.

Customer Acknowledgment

By electronically accepting the estimate or signing the agreement, the customer acknowledges that they have read, understood, and agreed to these Terms & Conditions, including the payment requirements, project preparation responsibilities, curing requirements, limitations, and warranty provisions.
